These Terms & Conditions (“Terms”) govern all bookings, services, and activities provided by Aquadventures (“we,” “our,” “us”). By booking any tour, dive, snorkel experience, rental, or service, you (“you,” “guest,” “customer”) agree to these Terms.

1. General Information

Aquadventures provides guided snorkel tours, Discover Scuba Diving experiences, and curated ocean activities in Cozumel, Mexico. Some activities, such as boat dives, are operated by trusted third-party dive operators who meet our safety and quality standards but are not owned by Aquadventures. By booking with us, you acknowledge and agree to this operational structure.
 

2. Booking Requirements

To reserve an activity:

  • Full name and contact information are required.

  • A valid email address must be provided for confirmations and updates.

  • Payment may be required at the time of booking (depending on the activity).

  • All participants must meet the minimum age, health, and skill requirements listed on the activity page.


3. Cancellations, Refunds & Credits

We understand that travel plans may change. Our cancellation policy is designed to be fair while respecting the time and resources required to operate your experience.
 

A. Weather & Port Closure Cancellations

If your tour must be canceled due to:

Cozumel port closure, or your cruise ship not docking in Cozumel

➡️ You will receive a 100% refund.

 

B. Standard Cancellation Policy
Time Before Activity - Refund Amount

  • 15+ days prior = 100% refund

  • 8–14 days prior = 50% refund (optional credit available)

  • 7 days or less = No refund (unless due to documented medical emergency)

  • All refund requests must be submitted in writing via email.
     

4. Third-Party Dive Operations

For boat dives, Aquadventures may arrange your booking with a third-party dive operator.

By booking, you acknowledge:

  • The dive boat, captain, and crew are operated by an independent company.

  • Aquadventures does not own or directly control the vessel or equipment used during boat dives.

  • Safety standards, insurance, and emergency procedures follow the policies of the third-party operator.

  • We carefully choose partners who uphold safety and professionalism to ensure the best experience.
     

5. Participant Responsibilities

All guests are responsible for:

  • Following the instructions given by guides and dive professionals

  • Being physically able to participate in the activity

  • Wearing required safety gear

  • Arriving on time at the designated meeting point

  • Disclosing any medical conditions that may affect participation

  • Late arrivals may result in forfeit of the activity without refund.
     

6. Health, Safety & Medical Requirements

For scuba diving and certain water activities:

  • You must be in good health

  • Certain medical conditions require a doctor’s approval

  • Asthma, heart issues, and lung conditions may require special evaluation

  • Guests under the influence of alcohol or drugs will not be permitted to participate

  • If a guest is deemed unfit to dive or snorkel for safety reasons, Aquadventures or the third-party dive operator may refuse participation without refund.
     

7. Liability

By participating in any Aquadventures activity, you agree to the following:

  • Water activities involve inherent risks

  • You participate voluntarily and at your own risk

  • You release Aquadventures and its staff from liability for injuries that occur due to non-compliance with safety instructions, negligence on the part of the participant, or inherent risks of marine activities

  • All participants may be required to sign a liability waiver before the activity begins.
     

8. Changes to Activities

Aquadventures reserves the right to:

  • Modify itineraries due to weather, safety, or operational conditions

  • Substitute a similar activity if required

  • Change meeting times or locations with advance notice

  • We always prioritize guest safety and aim to deliver the best possible experience.
     

9. Pricing & Payments

Prices may vary based on:

  • Seasonal changes

  • Availability

  • Third-party operator rates

  • Promotional discounts

  • Taxes or fees may apply depending on the activity or location.
     

10. Photography & Media

During activities, photos or videos may be taken. By participating, you grant Aquadventures permission to use these images for promotional purposes unless you request otherwise in writing.

11. Personal Belongings

Aquadventures is not responsible for:

  • Lost or damaged personal items

  • Items left on the boat, beach, or meeting points

  • Please secure your belongings before participating.
     

12. Governing Law

These Terms are governed by the laws of Mexico, specifically the jurisdiction of Quintana Roo. Any disputes will be handled in local courts unless mutually resolved through mediation.
